MARTINSBURG, W. Va. – A Hagerstown man has been found guilty of multiple counts of sexual abuse charges in a Berkeley County Circuit Court case.

Berkeley County Prosecuting Attorney Joseph R. Kinser says on Thursday, March 13, 2025, a Berkeley County jury found Giorgio Leopoldo Capone, age 73, of Hagerstown guilty of Sexual Abuse in the 1st Degree, Sexual Abuse by a Person In Position of Trust, three Counts of Filming a Minor in Sexually Explicit Conduct, and Possession of Child Pornography (50-599 Images) arising from a 2016 investigation.

Capone faces a maximum sentence of twenty-four and a half to eighty-five years in prison and fifty years of supervised release thereafter. Capone will also be required to register as a sex offender for the remainder of his life.

A sentencing hearing is scheduled for May 29, 2025 at 11:00 a.m.

The two-day trial was held before Judge Debra M. H. McLaughlin of the 27th Judicial Circuit.

In announcing the conviction, Prosecutor Kinser said the case was investigated by the West Virginia State Police and the Washington County Sheriff’s Office

He expressed his appreciation for West Virginia State Police Sgt. J.D. See for her investigation in this case “and for her unfailing efforts to protect children in our community.”

He also thanked Sgt. Howard Ward of the Washington County Sheriff’s Office for his assistance and the jury for “carefully weighing the evidence and providing a verdict that achieves justice for the victim and the community in this case.”
