MARTINSBURG, W. Va. – A Berkeley County man convicted on multiple counts related to sexual assault from 2024 now faces 27 to 73 years in prison.

Berkeley County Prosecuting Attorney Joseph R. Kinser says a Berkeley County jury found Cody Gene Eggleton, 24, of Martinsburg guilty Friday of Malicious Assault, Attempted Second-Degree Murder, Strangulation, Wanton Endangerment, two Counts of Sexual Assault in the Second-Degree, Domestic Assault, two counts of Domestic Battery, Interfering with Emergency Communications, and Unlawful Restraint.  The charges stem from  from a sexual assault that occurred on or between January 29, 2024, and January 31, 2024, in Capital Heights.

Eggleton now faces a maximum sentence of twenty-seven and a half to seventy-three (27.5–73) years in prison and fifty (50) years of supervised release thereafter. Eggleton will also be required to register as a sex offender for the remainder of his life.

Sentencing is set for March 14th.

Upon the return of the jury’s verdict, the Defendant was remanded to custody to await sentencing. A sentencing hearing is scheduled for March 14, 2025, at 1:00 p.m. The four-day trial was held before the Honorable Judge Debra M. H. McLaughlin of the 27th Judicial Circuit.
